Terms of Service

1. Acceptance of Terms

By accessing the ArtArray website (ArtArray.ai), downloading our mobile application, or using our AI image generation services, you agree to be bound by the following terms and conditions. These Terms apply to all users of ArtArray's services. If you do not agree with any of these terms, you should discontinue use of our services immediately. We reserve the right to update or modify these terms at any time, and such changes will be effective upon posting.

2. AI Image Generation Services

  • Service Description: ArtArray provides AI-powered image generation services that transform your photos into various artistic styles using advanced machine learning algorithms. Our services include professional headshots, artistic transformations, and custom text art generation.
  • Generation Process: When you submit a photo for AI processing, the transformation typically takes 30-60 seconds. Generated images are delivered to your account within the app. We cannot guarantee specific results as AI generation involves creative algorithms that may produce varied outputs.
  • Content Guidelines: You may only upload photos that you own or have permission to use. Prohibited content includes illegal material, copyrighted content (without permission), inappropriate images, or content that violates our community guidelines.
  • Service Availability: We strive to maintain service availability but cannot guarantee uninterrupted access. Services may be temporarily unavailable due to maintenance, updates, or technical issues.

3. Subscriptions and Payments

  • Free and Premium Services: ArtArray offers both free and premium subscription tiers. Free users have access to basic generation features with usage limits. Premium subscribers enjoy unlimited generations, exclusive presets, and enhanced features.
  • Subscription Billing: Premium subscriptions are billed through your device's app store (Apple App Store or Google Play Store) or our web payment processor (Stripe). Subscriptions auto-renew unless cancelled before the renewal date.
  • Cancellation Policy: You may cancel your subscription at any time through your device settings or account dashboard. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial periods unless required by law.
  • Price Changes: We reserve the right to modify subscription prices with 30 days advance notice. Existing subscribers will be notified of price changes and may cancel before the new pricing takes effect.

4. Content and Intellectual Property

  • Your Content Ownership: You retain ownership of photos you upload and the AI-generated images created from them. You are responsible for ensuring you have rights to any photos you upload for processing.
  • ArtArray Platform Content: All preset styles, AI models, app interface, and promotional content are owned by ArtArray and protected by copyright and other intellectual property laws.
  • Usage Rights: Generated images are for your personal use. Commercial use may require additional licensing. You may not reverse engineer our AI models or attempt to replicate our technology.
  • Content Moderation: We reserve the right to review and remove generated content that violates our guidelines, applicable laws, or infringes on third-party rights.

5. User Responsibilities

  • Prohibited Use: You must not use our services for illegal purposes, upload copyrighted content without permission, attempt to reverse engineer our AI technology, create harmful or inappropriate content, or violate any applicable laws or regulations.
  • Account Security: You are responsible for maintaining the security of your account credentials. Notify us immediately if you suspect unauthorized access to your account.
  • Age Requirements: You must be at least 13 years old to use our services. Users under 18 require parental consent. We comply with COPPA and other applicable privacy laws for minors.
  • Suspension and Termination: We may suspend or terminate accounts that violate these terms, engage in abusive behavior, or pose security risks to our platform or other users.

6. AI Technology Disclaimers

  • AI Limitations: Our AI technology is continuously improving but may not always produce expected results. Generated images are created by algorithms and may contain artifacts, inconsistencies, or unexpected elements.
  • No Guarantee of Accuracy: AI-generated content should not be relied upon for identity verification, medical purposes, or any critical applications. Results are for creative and entertainment purposes.
  • Bias and Fairness: We work to minimize bias in our AI models, but acknowledge that AI systems may reflect biases present in training data. We continuously improve our systems to ensure fair and inclusive results.

7. Limitation of Liability

To the fullest extent permitted by law, ArtArray shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, arising from your use of our AI image generation services.

In no event shall ArtArray's aggregate liability for any claim related to our services or these terms exceed the amount you paid for subscription services in the twelve (12) months preceding the claim.

8. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of Vietnam, where ArtArray is based. By using the site or ordering, you agree that any dispute that cannot be resolved amicably shall be resolved in the competent courts of Vietnam, unless otherwise required by consumer protection laws of your country of residence.

Privacy Policy

At ArtArray, we respect your privacy and are committed to protecting your personal information. This Privacy Policy explains how we collect, use, and share your information when you use our AI image generation mobile application, website, or services, and what choices you have with respect to your data. By using ArtArray, you agree to the terms of this Privacy Policy.

1. Information We Collect

  • Personal Information You Provide: When you create an account or use our AI image generation services, we collect information necessary to provide our services. This may include your name, email address, profile information, and payment details for premium subscriptions. When you upload photos for AI processing, those images are temporarily processed to generate your requested artwork.
  • Payment Information: Premium subscriptions and in-app purchases are processed through secure payment providers (Apple App Store, Google Play Store, and Stripe). We do not collect or store your credit card numbers on our servers. We only receive confirmation that payment was completed.
  • Automatically Collected Information: When you use our app or website, we may automatically collect certain information about your device and usage patterns. This can include your device type, operating system, app version, IP address, usage statistics, and generated image preferences.
  • Cookies and Similar Technologies: Our website uses cookies and similar technologies to enhance your experience. These help maintain your session, remember your preferences, and understand how you interact with our services.

2. How We Use Your Information

ArtArray uses the collected information for various purposes:

  • Service Delivery: We use your information to provide our AI image generation services, including processing your uploaded photos, applying AI transformations, managing your account, and delivering your generated images.
  • Communication: We may use your contact information to communicate with you about your order status, respond to your inquiries, or send important notices (such as updates to our terms or privacy policy). You can opt out of marketing emails at any time.
  • Improvement of Services: Information like website usage data helps us understand user behavior and preferences, so we can improve our website layout, product offerings, and overall user experience.
  • Legal and Security: We may use information to prevent fraud and protect the security of our website and business, and to comply with legal obligations or enforce our Terms and Conditions.

3. AI Processing and Image Handling

Special considerations for AI-generated content:

  • Image Processing: When you upload photos for AI transformation, they are temporarily processed on secure servers. Your original photos and generated images are encrypted during transmission and processing. Original uploads are automatically deleted from our processing servers within 24 hours after generation is complete.
  • AI Model Training: We do NOT use your personal photos to train our AI models without explicit consent. Your images remain private and are used solely to provide you with the requested service.
  • Generated Content Storage: Generated images are stored securely in your account for your access. You retain ownership of all AI-generated images created from your photos. You may download or delete your generated content at any time through the app.
  • Content Moderation: We employ automated systems to detect and prevent the generation of inappropriate, illegal, or harmful content to maintain platform safety and comply with legal requirements.

4. How We Share Your Information

We understand that your personal information is important, and we only share it in limited situations:

  • Service Providers: We share necessary information with third parties who help us run our services:
    • • AI Infrastructure Providers: We use cloud computing services (Google Cloud Platform and Cloudflare) to process AI transformations following strict data protection protocols.
    • • Payment Processors: Subscription payments are handled through Apple App Store, Google Play Store, or Stripe according to their own privacy policies.
    • • Analytics Services: We use analytics tools to understand app usage and improve our services with anonymized data.
  • Legal Requirements: We may disclose your information if required to do so by law or in response to valid requests by public authorities.
  • Protection of Rights: We may disclose personal information if necessary to investigate, prevent, or take action regarding illegal activities, suspected fraud, or violations of our Terms and Conditions.
  • Business Transfers: In the unlikely event that ArtArray is involved in a merger, acquisition, or sale of assets, customer information may be transferred to the new ownership as part of that transaction.

Importantly, we do NOT sell or rent your personal information to any third-party for their own marketing purposes.

5. Data Retention

We will retain your personal information only for as long as necessary to fulfill the purposes for which we collected it, including to satisfy any legal, accounting, or reporting requirements. We may retain aggregate or anonymized data (which does not identify you personally) for analytical purposes. If you request deletion of your data, we will do so as long as we are not required to keep it for legal reasons.

6. Security of Your Information

We take reasonable measures to protect your personal information from unauthorized access, loss, misuse, or disclosure. Our website uses HTTPS encryption to ensure data is securely transmitted. We and our service providers employ security practices such as firewalls, secure servers, and data encryption where applicable. However, please understand that no method of transmission over the Internet or electronic storage is 100% secure.

7. Your Rights and Choices

Depending on your location, you may have certain rights regarding your personal information:

  • Access and Correction: You can request to know what personal information we have about you and request corrections to any inaccurate data.
  • Deletion: You can request that we delete your personal data. Keep in mind we may need to retain certain information for legal or internal business reasons.
  • Opt-Out of Marketing: If you have subscribed to our newsletter or marketing emails, you can unsubscribe at any time using the link in those emails or by contacting us.
  • Do Not Track: Some browsers offer a "Do Not Track" feature. At this time, our site does not respond to Do Not Track signals, but we do not track your activity across other sites.

8. Children's Privacy

ArtArray's website and services are not directed to children under 13 years of age (or the minimum legal age in your jurisdiction). We do not knowingly collect personal information from children. If we learn that we have inadvertently collected personal data from a child under 13, we will take steps to delete that information promptly.

9. International Data Transfers

ArtArray is based in Vietnam, but we serve customers around the world. If you are located outside of Vietnam, your personal data may be transferred across international borders to process your orders or store data. We will handle your information in accordance with this Privacy Policy no matter where it is processed.

10. Changes to This Policy

We may update our Terms and Privacy Policy from time to time to reflect changes in our practices or for other operational, legal, or regulatory reasons. If we make material changes, we will notify you by posting an updated policy on our site with a new effective date, and/or by emailing you if you have an account with us. Your continued use of ArtArray's services after any changes constitutes your acceptance of the changes.
