1. Acceptance of Terms

By accessing the ArtArray website (ArtArray.Ai) and/or placing an order, you agree to be bound by the following terms and conditions. These Terms apply to all visitors and customers of ArtArray. If you do not agree with any of these terms, you should discontinue use of our site. We reserve the right to update or modify these terms at any time, and such changes will be effective upon posting to the website. It is your responsibility to review the terms periodically for updates.

2. Products and Ordering

  • Order Process: When you place an order, you will receive an email confirmation. This confirms we have received your order request. Once payment is verified, we begin the fulfillment process. Orders go into production quickly (often within hours), so please double-check your cart before confirming purchase.
  • Order Changes/Cancellation: If you need to cancel or modify an order, contact us immediately. We will try to accommodate your request if production has not started. However, if an order is already being printed or has shipped, we may not be able to change or cancel it. In such cases, our Return/Refund Policy (see below) will apply.
  • Order Acceptance: We reserve the right to refuse or cancel any order for reasons including errors in pricing, unforeseen supply issues, or suspicion of fraud. If we cancel your order, we will notify you and issue a full refund promptly via your original payment method.

3. Pricing and Payment

  • Currency: Unless otherwise stated, all prices on our site are in U.S. Dollars (USD).
  • Payment Method: We accept payment through PayPal, which supports major credit and debit cards. Payment is due in full at checkout. We will not begin production of your items until the payment has been successfully processed.
  • Payment Security: All payments are processed securely through PayPal's platform. Your credit card details are not shared with us during the transaction PayPal employs industry-standard encryption and security measures to protect your financial information.
  • Billing Information: You agree to provide current, complete, and accurate purchase and account information for all orders. Providing false information (including using unauthorized payment methods) may result in order cancellation. Fraudulent orders will be reported to the proper authorities.

4. Production and Shipping

  • Production Time: After your order is placed and paid, our production partners will print and prepare your items. Production times typically range from 2 to 7 business days before shipment. Production can occasionally take longer during peak seasons or if an item is out of stock; we will inform you if there are significant delays.
  • Shipping Services: We offer Standard Shipping for most orders. Once produced, domestic U.S. orders usually arrive within 2–5 business days. International delivery times vary, roughly 10-30 business days depending on destination and customs. Please note these timeframes are estimates and not guaranteed.
  • Shipping Confirmation: You will receive a shipping notification email with tracking information (if available) when your order is on its way. It may take 1-3 business days for tracking info to update after dispatch.
  • Shipping Address: Please ensure your shipping address is correct at checkout. We are not responsible for orders delivered to an incorrect address provided by the customer. If a package is returned to us due to an incorrect address, we can reship it to a corrected address at your expense (additional shipping charges may apply).
  • Customs and Import Taxes: For international orders, buyers are responsible for any customs duties or import taxes that may be imposed by their country. We have no control over these charges and do not collect any such fees at checkout. Additionally, we are not liable for delays caused by customs processing. If you refuse a shipment due to customs fees, the package may be abandoned and no refund can be issued.
  • Delivery Issues: If a shipment is lost in transit or excessively delayed, please contact us. We will work with the carrier to resolve the issue. If necessary, we will send a replacement or issue a refund for lost orders. For packages marked as delivered but not received, see the FAQ above for steps to take; ultimately, we will assist you case-by-case to ensure you receive your product.
  • Force Majeure: ArtArray is not liable for delays or failures in delivery caused by events beyond our control, such as natural disasters, strikes, wars, epidemics, or transportation disruptions.

5. Returns, Refunds, and Exchanges

  • All Sales Final (with Exceptions): Because our products are custom-made for each order, all sales are considered final. We do not accept returns or exchanges if you ordered the wrong size, chose the wrong variant, or simply changed your mind, as products are made-to-order and cannot be resold. Please review product details and sizing information carefully before purchase.
  • Damaged or Defective Items: If you receive an item that is misprinted, damaged, or has a manufacturing defect, we will make it right by offering you a free replacement or a refund of the purchase price (including shipping). Conditions: You must contact us within 30 days of delivery and provide a description of the issue along with clear photos showing the problem. Once we verify the issue, we will process a reprint or refund. In most cases, you will not need to return the damaged item, but we may request that you hold onto it or dispose of it.
  • Wrong Item Received: In the unlikely event you receive the wrong product or a different design/size than what you ordered, please notify us within 30 days. We will arrange for a replacement of the correct item as quickly as possible, at no cost to you. We may request a photo of the incorrect item for verification.
  • Return Process: To request a replacement or refund for a damaged/defective item, please contact our support team (contact@artarray.ai) with your order number and evidence of the issue. Our team will respond with next steps. If a return of the item is deemed necessary, we will provide you with a return shipping address or let you know how to dispose of the item.
  • Refund Method: Approved refunds will be issued back to your original payment method (PayPal or credit card). Please allow a few days for the refund to process. We will notify you once the refund is issued.
  • Exceptions: Any issue reported more than 30 days after delivery will be addressed at our discretion. We reserve the right to refuse a refund/replacement if the claim is made outside the allowed time frame or if sufficient proof of the issue is not provided.
  • Fraudulent Claims: We take fraud seriously. Returns/claims that appear fraudulent or abusive (e.g., repeatedly reporting issues without substantiation) may be denied. We reserve the right to require the return of the original item before processing a refund in certain cases.

6. Intellectual Property and Usage Rights

  • Ownership of Content: All content on the ArtArray website, including but not limited to artwork images, designs, graphics, logos, text, and media, is the property of ArtArray and/or our content creators. This content is protected by United States and international copyright laws and treaties. Purchasing a product does not transfer ownership of the underlying artwork or intellectual property to you.
  • Personal Use Only: When you buy a product from ArtArray, you are granted a personal, non-transferable license to use the product (e.g., hang the canvas on your wall or wear the t-shirt). This does not include the right to reproduce, redistribute, or create derivative works from the artwork on the product. Unauthorized duplication or commercial use of the artwork is strictly prohibited.
  • No Commercial Use: You may not use ArtArray designs or artwork for any commercial purpose without explicit written permission from us. This includes, but is not limited to, reselling our products (outside of normal personal second-hand sales), printing the artwork on other items, using our images for marketing your own products, or any other exploitation of the artwork.
  • Trademarks: The ArtArray name and logo are trademarks of our company. You are not permitted to use our trademarks in any way that might cause confusion about the source of products or imply endorsement without our written consent.
  • Reporting IP Violations: We value our intellectual property rights and the rights of others. If you believe any content on our site infringes on someone's copyright or other IP rights, please notify us with details so we can investigate and take appropriate action.

7. Product Descriptions and Images

We strive to provide accurate descriptions and high-quality images of our products on our website. However, please note that colors on screen may appear slightly different from the actual product. Different monitors or device screens can display colors differently, and there may be minor variations in printing. We do not guarantee an exact color match to what you see on your screen. Minor differences in color or positioning that do not affect the overall design are not considered defects.

The dimensions and measurements provided for products (such as t-shirt sizes or canvas dimensions) are as accurate as possible. Slight variances can occur due to the manufacturing process (usually within standard tolerances).

8. Limitation of Liability

To the fullest extent permitted by law, ArtArray shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, arising from your use of our site or purchase of any products.

In no event shall ArtArray's aggregate liability for any claim related to a product or these terms exceed the amount you paid for that product.

The products sold on our site are for personal use, and ArtArray is not responsible for any harm or injury that could result from misuse of the products (for example, improper installation of a canvas frame, etc.). Always use products in accordance with their intended use and any instructions provided.

9. Privacy Policy

Your submission of personal information through the store is governed by our Privacy Policy. By using our site or placing an order, you acknowledge that you have read our Privacy Policy and consent to the collection and use of information as described therein.

10. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of Vietnam, where ArtArray is based. By using the site or ordering, you agree that any dispute that cannot be resolved amicably shall be resolved in the competent courts of Vietnam, unless otherwise required by consumer protection laws of your country of residence. We recognize that if you are a consumer in a different country, you may have certain rights or remedies under local law; these terms are not intended to limit any consumer rights that cannot be waived by contract under local law.

11. Dispute Resolution

In the event of a dispute, we encourage you to contact us first to seek a resolution. Many concerns can be resolved quickly by reaching out to our customer service. If we cannot resolve a dispute informally, and if you wish to pursue further action, such dispute shall be handled in accordance with the governing law provision above. (If you initiate a chargeback or PayPal dispute, we will provide evidence of fulfillment and these terms to support our case. We prefer to work directly with you to avoid misunderstandings.)

12. Seller's Rights

We reserve the right to refuse service to anyone for any reason at any time, particularly in cases of suspected fraud, abuse, or customers violating these terms. We also reserve the right to limit the sales of our products to any person, geographic region, or jurisdiction if deemed necessary (though it's our general policy to serve customers globally). In the event of any violation of these Terms, we may cancel your orders and/or terminate your access to the site.

13. Changes to Terms

ArtArray may update these Terms and Conditions from time to time. If we make material changes, we may notify users by posting a notice on our website or via email. However, it is ultimately your responsibility to review the Terms periodically. Your continued use of the site after any changes signifies your acceptance of the updated Terms. The "Last Updated" date at the bottom of this document indicates when the Terms were last revised.
